Acceptance of Terms

This document is an electronically generated record under the Information Technology Act, 2000 and the rules framed thereunder. It does not require any physical or digital signature to be legally valid.

It is published in compliance with Rule 3(1)(a) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Rule 4 of the IT (Reasonable Security Practices and Sensitive Personal Data) Rules, 2011.

www.growthmandap.com (“Platform” or “Website”) is owned and operated by Mohit Parihar (“Growth Mandap”, “We”, “Us”, “Our”). By accessing or using any part of this Platform, you (“User”, “You”, “Your”) agree to be fully bound by these Terms of Use (“Terms”).

If you do not agree with any part of these Terms, please stop using the Platform immediately. Your continued use of the Platform after any updates to these Terms will be treated as your acceptance of the revised version. We reserve the right to modify these Terms at any time without prior notice — it is your responsibility to check for updates periodically.

These Terms, together with our Privacy Policy, form a legally binding agreement between You and Growth Mandap. Any translation of these Terms is provided purely for convenience — the English version shall always govern in case of any inconsistency.

 

Eligibility

Access to and use of this Platform is available only to individuals who meet all of the following conditions:

  • Are citizens of India or Non-Resident Indians (NRIs)
  • Are at least 18 years of age
  • Are legally capable of entering into binding contracts under applicable Indian law
  • Are not barred from using online services by any law currently in force in India

By registering or using the Platform in any manner, you confirm that you satisfy all of the above eligibility criteria. Growth Mandap reserves the right to terminate your access if it determines at any time that you do not meet these requirements.

 

Nature of Services

Growth Mandap provides professional support, informational content, and digital tools through its Platform (“Services”). The nature and scope of these Services may evolve over time. We reserve the right to modify, suspend, or discontinue any feature or Service — either temporarily or permanently — at our sole discretion and without prior notice.

You may stop using our Services at any time without the need to formally notify us. However, if Growth Mandap disables your account for any reason, you may lose access to the Platform, your account data, and any files associated with your account.

Growth Mandap may impose limits on usage — such as storage capacity or the number of submissions — at any time, at its discretion.

 

Use of Services

To use certain Services on this Platform, you may be required to submit personal or professional information (“User Information”). You agree that all information you provide will be accurate, complete, and up to date. Growth Mandap shall not be held responsible for any errors, claims, or disputes arising from incorrect information submitted by you.

You agree to use the Platform only through the interface provided by Growth Mandap, and not through automated scripts, bots, crawlers, or any other means not expressly authorised by us. You must not engage in any activity that interferes with, disrupts, or damages the Platform or its underlying infrastructure.

You agree not to copy, reproduce, resell, distribute, or commercially exploit any part of the Platform or its content without our express written permission.

You acknowledge that Growth Mandap serves as a facilitating platform and is not liable for decisions made based on information provided through it. You are solely responsible for any outcomes resulting from your use of the Services.

⚠️ Growth Mandap will not be held liable for any data loss or breach caused by server hacking, third-party interference, or technical failures beyond our reasonable control.

 

Refund Policy

Both you and Growth Mandap retain the right to discontinue any Service arrangement at any time. Where a Service has already commenced and is actively underway, no refund will be issued as a matter of right.

Any amounts paid for Services that have not yet been initiated or delivered may be considered for refund at the sole discretion of Growth Mandap, subject to applicable terms at the time of the request. Refund decisions are final and will be communicated through registered contact details.

Privacy & Personal Data

Growth Mandap is committed to protecting your personal information. The manner in which we collect, store, process, and share your data is detailed in our Privacy Policy, available at www.growthmandap.com.

By using this Platform, you agree to the collection and use of your personal data as described in our Privacy Policy. Please read it carefully before using our Services.

 

Accuracy of Information

Growth Mandap takes reasonable steps to ensure that the content and information presented on this Platform is accurate and up to date. However, we do not provide any guarantee or warranty — express or implied — regarding the accuracy, completeness, timeliness, or suitability of any information published on the Platform.

You are responsible for independently verifying any information before acting on it. Growth Mandap and its team of professionals endeavour to interpret applicable rules and regulations in a fair and lawful manner; however, different professionals may arrive at different conclusions, and Growth Mandap shall not be held liable for any such variations or errors.

Any changes to laws, regulations, or guidelines applicable to our Services will be reflected on the Platform without unreasonable delay. However, Growth Mandap disclaims all responsibility to update content within any specific time frame.

⚠️ All content on this Platform is provided on an “as is” basis. Growth Mandap expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of accuracy, merchantability, or fitness for a particular purpose.

 

Account & Password Security

You are solely responsible for keeping your account credentials — including your username and password — confidential. All activities that occur under your account, whether authorised by you or not, are your responsibility.

If you become aware of any unauthorised access to your account or any suspected breach of your credentials, you must notify Growth Mandap immediately at growthmandap@gmail.com. Growth Mandap will not be held liable for any loss or damage arising from your failure to protect your login information.

Force Majeure

Neither Growth Mandap nor you will be held liable for any failure to fulfil obligations under these Terms if such failure results from events beyond reasonable control. Such events may include, but are not limited to:

  • Acts of God — floods, earthquakes, storms, or natural disasters
  • War, terrorism, civil unrest, strikes, or political instability
  • Government actions, regulatory changes, or legal mandates
  • Widespread technical failures, power outages, or internet disruptions

The party affected by such an event shall promptly notify the other party in writing and shall make all reasonable efforts to resume performance of its obligations as soon as the circumstances permit.

 

Jurisdiction & Dispute Resolution

Any dispute or disagreement arising out of or in connection with these Terms or your use of the Platform shall first be submitted to a sole arbitrator appointed by Growth Mandap, in accordance with the Arbitration and Conciliation Act, 1996.

These Terms are exclusively governed by and construed in accordance with the laws of India. By using this Platform, you consent to the exclusive jurisdiction of the courts located in Bhopal, Madhya Pradesh, India for all disputes not resolved through arbitration.

 

Limitation of Liability

Your use of this Platform and its Services is entirely at your own risk. Growth Mandap makes no representations about the reliability, suitability, or availability of the Platform or its content for any particular purpose.

To the maximum extent permitted by applicable law, Growth Mandap and its associates, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

  • Your use of or inability to use the Platform or its Services
  • Any content, information, or tools accessed through the Platform
  • Unauthorised access to or alteration of your data or transmissions
  • Conduct or actions of any third party on or through the Platform
  • Any technical errors, bugs, or server failures

The Platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control. Growth Mandap does not guarantee uninterrupted access.

Intellectual Property

All content on www.growthmandap.com — including but not limited to text, graphics, logos, icons, images, audio, video, software, and the overall design and layout — is the exclusive intellectual property of Growth Mandap or its licensed contributors, and is protected under applicable Indian copyright and intellectual property laws.

You are granted a limited, personal, non-transferable, non-exclusive, and revocable licence to access and use the Platform solely for its intended purpose. This licence does not permit you to:

  • Reproduce, copy, resell, or commercially exploit any part of the Platform
  • Download, store, or distribute Platform content for any purpose other than personal use
  • Use data mining tools, bots, scrapers, or automated systems on the Platform
  • Modify, reverse-engineer, translate, or create derivative works from any part of the Platform
  • Remove or obscure any copyright, trademark, or proprietary notices

Any unauthorised use of the Platform’s intellectual property will result in immediate termination of your licence and may be subject to legal action.

 

Prohibited Conduct

The Platform is intended strictly for lawful, personal, and non-commercial use. You agree not to use or access the Platform to host, upload, share, publish, or transmit any content or information that:

  • Belongs to another person and to which you hold no rights or permissions
  • Is defamatory, obscene, pornographic, threatening, harassing, or otherwise unlawful
  • Harms, endangers, or exploits minors in any way
  • Infringes on any patent, trademark, copyright, trade secret, or other proprietary right
  • Impersonates any individual, organisation, or entity
  • Contains malware, viruses, or any code designed to interfere with system functionality
  • Is knowingly false, misleading, or likely to deceive recipients
  • Promotes or facilitates illegal activity, money laundering, or gambling
  • Threatens national security, sovereignty, or public order

Violation of these conduct standards may result in immediate suspension of your account, removal of content, and/or legal proceedings.

 

Anti-Spam Policy

Growth Mandap takes a firm stance against unsolicited bulk communications (spam). All inbound communications to our Platform undergo spam screening, and messages identified as spam will be rejected. Senders will receive appropriate notification to enable corrective action.

We employ a combination of technical filters and manual review to minimise spam-related disruptions. Growth Mandap reserves the right to report persistent or malicious spam activity to relevant authorities and to take any further action it considers necessary.

 

Third-Party Links

The Platform may contain links to external websites or services operated by third parties. Growth Mandap does not review, endorse, or take responsibility for the content, accuracy, or privacy practices of any linked third-party website.

The presence of a link on our Platform does not imply our approval or association with the linked site. Any transactions, dealings, or interactions you have with third parties through such links are entirely between you and that third party. Growth Mandap shall not be liable for any outcomes arising from your use of external links.

Advertisements displayed on our Platform are served by third-party networks. Growth Mandap is not responsible for any representations, claims, or promises made in such advertisements.

 

Communications & Notices

Growth Mandap may communicate with you through one or more of the following channels, based on the contact details you have provided:

  • Email to your registered email address
  • SMS or voice call to your registered mobile number
  • Push notifications through the Platform or mobile application
  • Messaging platforms such as WhatsApp or similar services
  • Notices posted directly on the Platform

By providing your contact details, you consent to receive communications through any of these channels. If your mobile number is registered under the DND/NCPR list maintained by TRAI, you may not receive certain SMS or call communications. In such cases, you agree to take the necessary steps to update your DND preferences and will not hold Growth Mandap liable for any resulting non-delivery.

It is your responsibility to keep your contact information updated. Any notices you wish to send to Growth Mandap should be addressed to growthmandap@gmail.com. All official correspondence will be conducted in English.

Growth Mandap does not guarantee the uninterrupted delivery of electronic communications and shall not be liable for messages that are lost, delayed, corrupted, or not delivered for reasons outside our control.

 

Call Recording Consent

When you connect with Growth Mandap representatives over a call, you expressly consent to the recording of such conversations. Call recordings may be used for the following purposes:

  • Quality AssuranceTo monitor and maintain the standard of our customer interactions.
  • TrainingTo help our team deliver better support and service.
  • Dispute ResolutionRecordings may be referenced as evidence in the event of a disagreement or complaint.
  • ComplianceTo meet legal or regulatory obligations, or when requested by an authorised authority.

Recorded calls will be stored, handled, and retained in accordance with our Privacy Policy and applicable data protection laws. Recordings will be securely deleted after the applicable retention period expires. Growth Mandap reserves the right to update its call recording practices; any changes will be communicated appropriately.

 

Account Deletion

You may request the deletion of your Growth Mandap account at any time by contacting us at growthmandap@gmail.com. However, please note the following conditions:

  • By agreeing to these Terms, you give Growth Mandap your express consent to retain certain data — either in full or in part — on our servers or cloud infrastructure, as required by law or our internal policies.
  • Data related to paid services, completed transactions, or filed recordswill not be deleted upon an account deletion request, whether made directly or through a third-party provider.
  • Upon account deletion, you will immediately lose access to your account, associated files, and records. This action is irreversible— deleted accounts cannot be restored.

Retention and deletion of all data following an account closure will be governed by our Privacy Policy and applicable legal requirements.

Delays in Service

Growth Mandap and its associates, employees, and representatives shall not be liable for any loss or disruption resulting directly or indirectly from service delays caused by factors outside our reasonable control, including but not limited to:

  • Equipment or telecommunication failures
  • Server downtime — whether on our end or that of a third-party provider
  • Severe weather, natural disasters, or other acts of God
  • Industrial action, civil disturbances, or armed conflict

During any such interruption, Growth Mandap is not obligated to maintain access to the Platform. We will make reasonable efforts to restore Services as quickly as possible.

 

Indemnification

You agree to indemnify, defend, and hold harmless Growth Mandap, its owner, employees, affiliates, agents, contractors, and partners from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use or misuse of the Platform or any of its Services
  • Any violation of these Terms or applicable law by you
  • Any breach of your representations, warranties, or commitments made under these Terms
  • Infringement of any intellectual property or other rights of a third party
  • Any content you upload, post, or transmit through the Platform that is harmful, unlawful, or in violation of these Terms

This indemnification obligation will survive the termination of your use of the Platform and these Terms.
